COOLY BIKES TERMS & CONDITIONS

AGREEMENT TO TERMS
By purchasing from Cooly Bikes, you agree to these Terms & Conditions for yourself and, where applicable, on behalf of any person you are purchasing for. If you do not agree with any part of these terms, or you do not have authority to agree on another person’s behalf, please do not complete your purchase.

These terms apply to all products sold by Cooly Bikes, including bikes, parts, accessories, and merchandise.

LIABILITY AND CUSTOMER RESPONSIBILITY
To the extent permitted by law, Cooly Bikes is not liable for any special, indirect, or consequential loss or damage arising from the use, misuse, or inability to use any product, even if we were advised that such loss may occur.

Once products are delivered or collected, you are responsible for their safe use, storage, maintenance, and operation. This includes (without limitation):

• Using products safely and as intended
• Understanding battery safety (charging, storage, transport, and general handling)
• Performing appropriate maintenance and safety checks
• Following all manuals, warnings, and safety guidance provided by Cooly Bikes and the manufacturer
• Complying with all applicable local, state, and federal laws, including road rules and age restrictions

ROAD-LEGAL INFORMATION
Where we describe a product as “road legal” or “street legal”, this is provided as general information only and is based on our understanding of applicable Australian e-bike regulations at the time of publication.

Rules can vary by state, council, park, trail, or private venue, and may change over time. You are responsible for confirming where and how you can legally ride. Cooly Bikes is not responsible for fines, penalties, or consequences arising from riding in restricted areas or using a product in a way that is not permitted.

WARRANTY
In addition to your rights under Australian Consumer Law, Cooly Bikes provides the following warranty coverage for manufacturing faults (subject to the exclusions below):

• Frame: 1 year
• Electrical components: 1 year

WARRANTY EXCLUSIONS
Warranty does not cover (without limitation):

• Normal wear and tear
• Damage from accidents, impacts, misuse, neglect, or poor maintenance
• Unauthorised modifications or non-approved parts
• Commercial use or hire use
• Tyre punctures and consumables
• Water damage (products may be water-resistant but are not waterproof)
• Cosmetic marks, including minor shipping scuffs (where applicable, touch-up paint may be provided)

ASSEMBLY AND ADJUSTMENTS
Some products may require minor adjustments after shipping or during initial setup. Any third-party servicing, assembly, or adjustments performed by a bike shop or mechanic are at your cost unless otherwise agreed in writing.

MAKING A WARRANTY CLAIM
To make a claim, contact us with proof of purchase. We may request photos, videos, and troubleshooting steps to assess the issue. Our technical team will determine whether the issue is covered under warranty.

SHIPPING AND DELIVERY
We will arrange delivery using third-party couriers. Delivery times provided are estimates only and may be affected by courier delays, scheduling issues, or factors outside our control.

Where signature on delivery is required, you are responsible for ensuring someone is available to receive the order. Any re-delivery fees charged by the courier may be your responsibility.

If an order is lost in transit, we will work with the courier to investigate and, where appropriate, arrange a replacement or other remedy in line with our obligations under Australian Consumer Law.

DAMAGED DELIVERIES
If your parcel arrives damaged, please take photos of the packaging and product as soon as possible and contact us promptly. You may be required to assist with courier or insurance claims.

RETURNS AND EXCHANGES
Returns are subject to our Returns Policy and must be authorised in writing by email before items are sent back. Return shipping costs are the customer’s responsibility unless otherwise required under Australian Consumer Law.

Items must be returned in original packaging and properly packed. If items are damaged during return transit due to inadequate packaging, you may be responsible for repair or replacement costs.

AFTER-SALES SERVICE AND PROOF OF PURCHASE
For warranty and after-sales support, we may require proof of purchase. If you purchased a product second-hand, you may be asked to provide the original receipt from the initial purchaser.

USER CONTENT PERMISSION
If you submit or share reviews, photos, videos, testimonials, or other content with Cooly Bikes (including via email or social media), you grant us permission to use that content for marketing and promotional purposes, unless you tell us otherwise in writing.

WEBSITE INFORMATION AND ERRORS
We aim to keep information accurate and up to date, however we do not guarantee the Site is free from errors or omissions. To the extent permitted by law, Cooly Bikes is not liable for losses arising from typographical errors or incorrect information. We may correct errors and update information at any time without notice.

FORCE MAJEURE
We are not responsible for delays or failure to perform caused by events outside our reasonable control, including natural disasters, pandemics, strikes, government actions, power outages, or supply chain disruptions. Where this occurs, we may need to delay, suspend, or cancel an order. We will contact you as soon as reasonably possible.
